The ASEP organization provides this site and related services subject to your compliance with the terms and conditions set forth below. Please read the following information carefully.

The ASEP Internet homepage and related Web pages are owned, operated, and controlled by the American Society of Exercise Physiologists (ASEP) from its National Office at 503 8th Ave W. Osakis, Minnesota USA. No material from the ASEP Web sites may be copied, reproduced, republished, uploaded, posted, transmitted, or distributed in any way, except that the Web sites may be download without alteration as one copy of the materials on any single computer for personal (private) and non-commercial home use, or classroom (educational use) only. Modification of the materials or use of the materials for any other purpose is a violation of ASEP's copyright and other proprietary rights. For purposes of this Agreement, the use of any such material on any other Web site or networked computer environment is prohibited.

ASEP does not warrant that its Internet Web site(s) or the "links" to other Internet addresses will be uninterrupted or error-free, that defects if any will be corrected or that the site(s) or the server that makes it available are free of viruses or other harmful components. The external Internet addresses contain information, published, maintained, or posted by institutions or organizations independent of ASEP. Under no circumstances, including, but not limited to, negligence, shall ASEP be liable for any special or consequential damages that result from the use of, or the inability to use, the Web site(s). ASEP does not specifically endorse, approve, certify, or control the external addresses and does not guarantee the accuracy, completeness, or efficacy of the information located at such addresses. Use of information obtained from such addresses is voluntary. It does not constitute or imply endorsement or recommendation by ASEP. This Agreement shall be governed by and construed in accordance with the laws of the State of Minnesota, without giving effect to any principles of conflict of law. If any provision of this Agreement shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this Agreement and shall not affect the validity and enforceability of any remaining provisions.

ASEP shall have the right at any time to change or discontinue any aspect or feature of its Web site(s), including, but not limited to, content or availability. ASEP shall have the right at any time to change or modify the terms and conditions applicable to use of its Web site(s), or any part thereof, or to impose new conditions, including, but not limited to, adding fees and charges for use of  its online electronic journals (JEPonlinePEPonline, JPEP, and the ASEPNewsletter, and any other online journals that may be published by ASEP. Such changes, modifications, additions, or deletions shall be effective immediately upon notice thereof, which may be given by means including, but not limited to, posting on ASEP's Web site(s) or by electronic or conventional mail, or by any other means by which Internet users obtain notice thereof. Use of ASEP's electronic journal Web site(s) after such notice shall be deemed to constitute acceptance of users of such changes, modifications, or additions.

While using the ASEP Web site(s) and related services, users agree not to post or transmit any unlawful, fraudulent, threatening, abusive, libelous, defamatory, obscene or otherwise objectionable or harmful information of any kind; post or transmit any commercial advertising regarding the sale of products or services of any kind; post or transmit any information or software that contains a virus, worm, trojan horse or other harmful or disruptive component; or post or transmit materials in violation of another party's copyright or other intellectual property rights.

ASEP has no obligation to monitor the home page or site-related services, users acknowledge and agree that ASEP has the right to monitor the site and site-related services and to disclose any information necessary to operate the ASEP Internet Sites properly and to protect itself and to comply with legal obligations. ASEP reserves the right to refuse to post or remove any information or materials, in whole or in part, that are in violation of this Agreement.

ASEP reserves the right to prohibit any user who, in ASEP's sole discretion, violates the Agreement or other terms of the Agreement from using the ASEP site and site-related services. Such prohibition may occur without notice to the user. Users agree to indemnify, defend, and to hold harmless ASEP against any and all claims, damages, costs, or other expenses that arise directly or indirectly out of or from the user's breach of this Agreement. Those who choose to access ASEP Web sites do so on their own initiative and are responsible for compliance with this Agreement.
